Book of legal-commercial – financial conditions concerning delivery of :/ 125/ton butter oil
HOMS dairy co. announces a call for external / internal offers for delivery of : 125/ton butter oil ± 25% to be submitted in sealed envelope . 1 - The bidder submit the offer to the registry of the company to the address : HOMS – HAMA Road the industrial area or to the P.O.Box no. /406/ HOMS , to be mailed or hand delivered and registered in the registry of the company and every offer reached after the determined date will be refused . 2 - Offers to be submitted within a big envelope fit to the mail transporting with a note : tender for delivery / 125 / tons of butter oil ( ghee ) stamped with the stamp of the bidder including two envelopes : A:- The first envelope includes the documents which notify that the conditions which are in article No./11/ from the law No./51/for the year 2004 for local bidder, but foreign bidder must declare that he is allowed to make tenders in Syria and he is not dealing with Israel and also the envelope includes the bid bond : - The foreign bidder \20000/Euro or its equivalent. - The local bidder :\1300000/ S.P . In the form of Bank bond issued ,confirm and legalized in favor of Homs Dairy co. or to be paid in the fund of the company , provided that he should offer the copy of the receiving notification by which the payment has done, or by a bank note issued by one of the official banks in Syria its validity not less than /90/days from the disclosing date ,Also the envelope should include an application of participation for the tender stuck on it a stamp at /1000/S..P ,also includes a buying note of the conditions book and a receipt of / 50 / S.P. to be paid in the company fund as local administration fees, and also includes a certified copy of the appointed agency of the foreign co. in Syria and this agency should be duly legalized for the year 2010 , the name of the agent the fax and phone no. , agency should be legalized from the ministry of commerce in Syria , the bidder should commit to the book of financial ,legal, commercial and technical conditions . B- The second envelope :includes the financial and commercial offers with a list of the unit and total prices and the price for foreign bidder is F.O.B & CFR, the goods origin must be mentioned, goods must be from countries permitted to import from ( for foreign bidder ) and the fixing will be done by the buyer plus mentioning the delivery period starting from the date of notification to open the documentary L/C .But as for the local bidder the price should be (arrived to the company stores )plus mentioning the delivery period starting from the working order receipt, plus mentioning the origin of the goods . - Declaration of the agent commission in order to be deducted from the L/C value to be paid to the agent by the company in the local currency after receiving according to the articles of the contract . 3 - The bidder should fix his elected domicile in details. phone and fax numbers e-mail if available. 4 - The period of the bidder's adherence to his offer is /90/days from the last date for submitting the offer. 5 - The period of the nominated contractor to his offer is/90/ days from notification date of his contracting the offer. 6 - The performance bond :/10%/ of the total value, it should be released after the final receipt of the good by a technical committee (concerning the foreign bidder)to be released from the financial directorate . 7 - Payment of the good value : A:for the foreign bidder the L/C should be opened as follows : -90%against the shipping documents( origin certificate – six copies – one copy must be duly legalized , complete bills of lading without reservation , an international control certificate , certificate of atomic radiation a list of contents and weight , a sanitary certificate proves that the goods is fit for food stuff industry . -10% of the total value after the final receipt of the good . B- as for the local bidder : The payment of the goods value should be done after the final receipt according to duly carried out minutes by a financial technical committee and the contractor should pay all the analyzing costs . 8 - The shipping must be exclusively via SYRIAMAR in case of apology, the contractor must ship by regular ships in use not more than/15/years otherwise he should pay fees for the old ship which should be imposed by establishment for insurance concerning the foreign bidder. 9 - During shipping the good must be far from any harmful materials. 10 - The delay fine it should be determined at /0.001/of the contract total value for each delayed day and at the most 20% of the total value, and if every quantity would be delivered alone , the delay fine should be according to the value of the delayed part of the delivery provided that the two following conditions should be taken into consideration : - The other quantities should be delivered within the determined dates . - The delayed part should be separated in the normal use and separated from the other delivered quantities . 11 - The successful bidder(foreign bidder) should pay the whole contract stamps (0.008) for both contract copies from the contract total value to be paid by foreign currency and deducted from the L/C and remitted to the financial department account. 12 - Concerning the local bidder . he also should pay the whole contract stamps (0.008) for both contract copies from the contract total value and to pay the stamps fee to the financial directorates provided that he should submit to the company the receipt by which the payment has been done , and also the local administration fees . 13 - The successful bidder should pay all taxes and fees resulting from this contract. 14 -The successful bidder should pay the costs of the announcement for one time. 15 -The foreign bidder should pay all the fees and expenses related to the documents in the origin country and in the arrival port. 16 -The buying party pledge to insure the good at the Syrian General Establishment of Insurance in case of F.O.B or C.F.R . 17 - The good should be packaged according to the applicable international specification of MARITIME transport and the seller is responsible for any damage of defect might occur to the good due to bad packaging , and the packaging materials are the possession of the buyer . 18 - For all matters for which no provision has been formulated in this book , the following are referred to the law No./51/ for2004 and the legislative decree No./450/ for 2004 and decree No./44/ for 2005 and any dispute that may arise should be settled amicably , in case of not reaching a solution , the dispute should finally settled in the courts of Homs according to the laws and regulations operative in Syrian Arab Republic .

Technical specifications for cow ghee ( butter oil)
Definition : Bovine shortening is a fat food stuff resulted from pasteurized cream that is directly taken from healthy cow milk after extracting the humidity and other non fat solid substances from it by heat. General terms: - The milk used in producing shortening must be identical to Syrian specification concerning raw milk . - The product must have a homogenous yellowish creamy color with a special taste and smell , and its stipulate that it must be free of rancid or any strange taste or smell. - The component must be shortening free of any lumps . - The product must be free of fats or any vegetable or animal fats or any vegetable oils both hydrogenated and non hydrogenated. - It is prevented to ad any coloring matters except beta carotene which allowed to be added to imported bovine shorting to give a suitable color . - It is allowed to add the following acidification deterrents: - Gallats of propin. - Galat of octal. - Galat of Dodocil with HYROXYL potilic Anissol . -Hydroxil potilic Altolin which should not exceed 200 m.g / k.g should not include more than 100m.g /k.g of thd galats . - Analytical specification : - Fat rate : 99.6% min . - Humidity : 0.3 % max. - Melting point : between 27-33 c. - The number Rechart Missel ( soluble volatile acids) 24 min . - The number of Polanski ( insoluble volatile acids) 1.5-5) . - Free acidity expressed as oil acids 0.3% max. - Peroxide value not greater than 5 ml. equivalent of ultra acidic oxygen per k.g of shortening . - Production of shortening should be according to conditions and instruction of committee of nourishment law no.1969/ /CAC/RCPI. - The sanitary conditions which must be realized in shortening as follows: - It should be free of microbe and molds . - It should be free of any substance resulting from microbe which can make it harmful . Packing : - The product should be filled in dry well – closed metallic barrels ,that protect the product from outer effects, and the internal layer should not interact on the filled substance , and the used barrels should be fit for packing food stuff specially shortening . - The net weight of each barrel should not exceed 210k.g and not be less than 100k.g . Data : - The following information should be mentioned on barrels.: - The name of substance and its kind . - The name and address of the producer ( factory) and its trade mark., production data and the date of expiry ( usability )month- year non written in symbols and unchangeable . - Country of origin . - Net and gross weight. - The shortening should be attached with an international supervision certificate which prove that it is not included radiation or other nuclear radiation . - The metallic pollutants ( if any ) should be within limits of the Syrian specification concerning ghee manufactured from cow milk , No. 370/ 1985 . - It must be attached with a sanitary certificate prove its goodness for human consumption in the origin country on the lading date . - It should be identical to sanitary conditions adopted in - Syrian Arab Republic . - It s age should not exceed three months starting from lading date /for imported bovine /. - The only reference is the Syrian specification No.370/1985 concerning shortening that produced from cow milk ( when adopting analyzing results) . - Its validity should not be less than one year on the date of delivery to the company ( for local offers).
